Native American items
Native American human remains, gravesite-related items, and burial items may not be listed on eBay. Native American masks and "prayer sticks" from all Southwestern tribes are also prohibited. This prohibition includes Native Hawaiian human remains, gravesite-related items and burial items.

Artifacts taken from any federal, state, public Department of Interior Agencies (NPS, BLM, USFWS) and Department of Agriculture Agencies (USFS), Native American land, or battlefield are prohibited for sale.

Cave formations
The sale of speleothems, stalactites, and stalagmites from caves on any federal land is prohibited by federal law. See The Federal Cave Resources Protection Act of 1988. Many states also prohibit the sale and/or removal of speleothems, stalactites, and stalagmites taken from caves. Please be sure your item complies with all applicable laws before listing it for sale.

An item lawfully removed from private land is permitted. However, government survey markers, such as those issued and marked by the U.S. Geological Survey, may not be listed unless accompanied by a clear scan of proof that the government has transferred ownership of the marker to a private person or entity.

These items may not be listed on eBay. While we recognize that some historical grave markers may be privately held within families and legal to sell, eBay is concerned with vandalism that has occurred in graveyards across the world.

Native American crafts
Sellers need to be very specific and comply with federal law when describing their post 1935 art, or craft, as a Native American piece. Under the Indian Arts and Crafts Act, all arts or craftwork offered for sale as American Indian or Alaska Native must be made by an enrolled member of a state or federally recognized Indian tribe or by an individual certified as an Indian artisan by the governing body of an Indian tribe. If you're representing your arts and crafts related item as an "American Indian" or "Alaska Native" piece, you are required to include the name of the artisan who made the item, as well as the name of the tribe of which he or she is a member.  If the artisan is not a member of a tribe, but is certified by the governing body of a tribe, this information must be included in the listing.

If the artisan name and tribe or certifying tribe in unknown, the piece may not be described as "Native American", "American Indian", or "Alaska Native". These items are also not allowed to be listed in the categories designed for authentic arts and crafts.

Native American reproductions must be clearly marked as such. You must also state this in the item description. The font size of this reference text must be identical to that of the rest of the listing. In addition, these items must be listed in the "Reproductions" category, which resides under the Native Americana category. Failure to comply with the above text reference or category selection will result in the termination of the listing. This policy applies to all Native American items, including crafts and artifacts.
